GENERAL SALES CONDITIONS

For private and professional events (excluding weddings)

ARTICLE 1 - Conditions of application

These terms and conditions apply to all services provided by Domaine des Saints Pères for private and professional events (excluding weddings). Any acceptance and signature of the quotation implies the customer's full and unreserved acceptance of these conditions, to the exclusion of any other complementary document.

ARTICLE 2 - Quotation and event confirmation

All private or professional event organization services (excluding weddings) must be covered by a detailed, personalized quote sent or handed to the customer. This estimate includes the designation and type of services determined on the basis of the customer's request, as well as the related terms and costs. Once accepted and signed, the quotation serves as a contract and commitment.

ARTICLE 3 - Confirmation of service

The customer appoints the Domaine des Saints Pères, which accepts responsibility for organizing the event, under the conditions set out herein and according to the criteria detailed in the quote. The reservation is only confirmed upon receipt of the signed quote.

ARTICLE 4 - Obligation of the organizer

The Domaine des Saints Pères undertakes to organize the event booked by the customer in accordance with the terms of the quotation. The obligations of the Domaine des Saints Pères with regard to compliance with the criteria may be redefined if more precise specifications are drawn up and accepted by both parties.

The Domaine des Saints Pères undertakes not to divulge any information supplied by the customer, which will be treated as confidential. Any information gathered in the course of drawing up the specifications may be communicated to Domaine des Saints Pères' commercial partners, who will be bound by the same rules of confidentiality. The data disclosed by the customer will be kept by the Domaine des Saints Pères and/or its commercial partners for the time necessary to manage and process the file and will be archived for a reasonable period. In accordance with the French Data Protection Act 78-17 of 6 January 1978, the processing of nominative information relating to the customer is subject to a declaration to the Commission Nationale de l'Informatique et des Libertés (CNIL).

The customer has the right to access, modify, rectify and delete data concerning him/her, which he/she may exercise by contacting : Domaine des Saints Pères, 1540, route de la Chartreuse 73000 MONTAGNOLE

ARTICLE 5 - Customer obligations

The customer shall facilitate access to any information Domaine des Saints Pères may require. The customer undertakes to accept and comply with the special conditions of the selected participants, and in particular to pay any bond or guarantee that may prove necessary before full payment of the sums due.

ARTICLE 6 - Prices

Prices as shown on the quotation are quoted in euros and are payable exclusively in this currency, whatever the nationality of the customer. They correspond to the rates for the various services described and are valid only for those services on the date indicated. Prices are increased by taxes at the rate in force on the date of invoicing.

ARTICLE 7 - Booking and payment conditions

To be valid, all reservation confirmations must be accompanied by a signed quotation, no later than 10 days before the date of the event. Any delay in signing the quotation will incur penalties of €100/day over 10 days before the event.

Payment methods accepted:

- By credit card

- By bank transfer: transfer fees payable by the customer if applicable

- By cheque payable to Domaine des Saints Pères, in euros

The definitive number of guests, as well as the unique choice of menu, must be communicated to us at least 10 days before the event. The number validated at that time will be the basis for invoicing; no discount will be granted, as all our costs are incurred.

This final number may be up to 20% lower than the number announced on the initial quote at the time of signature. The minimum basis for invoicing is therefore the number of guests announced on the signed estimate for the event -20%.

ARTICLE 8 - Cancellation policy and charges

- Cancellation up to 2 months prior to event date: no cancellation fees

- Cancellation between 2 months and 3 weeks before the date of the event: cancellation charges equal 50% of the total amount of the quote signed on departure

- Cancellation less than 3 weeks prior to the event: cancellation charges equal 100% of the total amount of the quote signed at the outset

 

ARTICLE 9 - Liability

The Customer is responsible for any damage, direct or indirect, that he or the participants may cause during the event. The Customer declares and warrants that he/she has full legal capacity to enter into the contract, and that he/she holds valid civil liability insurance. To this end, the Customer undertakes to waive, and to have its insurers and/or any guests waive, any recourse against the organizers in the event of any damage whatsoever arising from the aforementioned events.

The Domaine des Saints Pères declines all responsibility for damage of any kind (theft, damage, etc.) affecting goods of any kind (personal effects, equipment, etc.) brought by the customer or belonging to participants, or service providers, regardless of where the goods are stored (parking lot, lounges, etc.). The Domaine des Saints Pères will be released from any obligation in the event of a force majeure or fortuitous event (strike, fire, water damage ....) and would prevent the execution of the event. Under no circumstances can the Domaine des Saints Pères be held responsible for direct or indirect prejudice linked to the execution of services provided by external service providers, who are solely responsible to the Customer.

ARTICLE 10 - Cancellation insurance

Cancellation by the Customer : in the event of withdrawal, refusal or cancellation on the part of the Customer, the Domaine des Saints Pères will be released from all obligations and the Customer will not be entitled to claim either the postponement of the event to another date, or the cancellation of the event.event to another date, nor to the reimbursement of sums already paid or to the cancellation of sums to be paid, according to the conditions defined in article 8 of these GCS.

Cancellation by the Domaine des Saints Pères: in the event of cancellation by the Domaine des Saints Pères of a service to be provided, the Domaine des Saints Pères is covered by professional liability insurance. It cannot be held

responsible for delays in the organization due to force majeure such as traffic accidents, human accidents, strikes, bad weather, revolts, demonstrations ...

ARTICLE 11 - Claims and disputes

Any dispute or claim will only be taken into consideration if it is made by registered letter with acknowledgement of receipt addressed to the Domaine des Saints Pères within a maximum of 10 days after the end of the event. In the event of a dispute, the case must be submitted to the competent courts in the town where the Domaine des Saints Pères head office is located.
